Self-Assessment Under the PPWR: Conformity Without a Notified Body

No third-party approval stands between a manufacturer and the market - which places the whole weight on internal rigour. How self-assessment works, what presumption of conformity does, and the internal challenge function that replaces the external examiner.

The short answer

The PPWR's conformity assessment is internal production control: the manufacturer assesses the packaging against the applicable requirements, compiles the technical documentation, issues the declaration, and places the packaging - with no notified body examination, no certificate, and no prior approval. Market surveillance then polices the system after the fact, with powers to demand the file, test the product and order corrections. The absence of a gatekeeper is not the absence of scrutiny; it is scrutiny deferred to the moment of maximum inconvenience, which is why the internal system has to supply the rigour the external examiner would have.

This guide covers the model's mechanics and the internal challenge function that makes self-assessment honest.

Presumption of conformity: the standards route

Where a requirement is covered by a harmonised standard cited in the Official Journal, or by the regulation's own criteria and methodology acts, conformity with those instruments gives presumption of conformity with the requirement - the recognised, low-friction route. The file should take it wherever it exists (recyclability criteria, calculation methodologies, test methods) and record the citation version applied. Where no standard route exists, the manufacturer assesses directly against the requirement's text, with its reasoning documented to a higher standard of explicitness - the direct route is lawful, but its file must do the persuading a standard's citation would otherwise do. Tracking which requirements have standard routes, and migrating files onto them as citations land, is a standing item in the acts calendar.

The internal challenge function

Self-assessment fails through kindness: the person who designed the pack assesses the pack, and optimism files the paperwork. The corrective is structural - a review step, before declaration signature, by someone with no authorship of the design and a mandate to find the file's weaknesses: the applicability index probed, the evidence sampled against its sources, the supplier declarations re-read for specificity, the calculations re-run on a sample. In large businesses this is a regulatory-affairs gate; in small ones, a reciprocal arrangement between two competent people, or an external reviewer on the critical families, achieves the separation. Record the challenge: reviewer, date, findings, dispositions. A file that shows it was attacked by its own side and survived is the strongest self-assessment artefact there is.

Designing for the surveillance mirror

Post-market surveillance reads files forensically and samples products physically; the design response is traceability between the two. Every physical claim the surveillance laboratory can test (metals sum, PFAS screen, recycled content basis, grade behaviour) should resolve to file evidence generated before the placing - because evidence generated after a surveillance request is visibly after. Run the mirror internally on a cycle: select placed packagings at random, pull their files cold, sample-test one physical property per cycle, and log the exercise. Businesses that rehearse surveillance rarely fear it, and the rehearsal log is itself producible evidence of a functioning system when the real request arrives.

A note on insurance and customer audits

Two private systems will examine self-assessment more often than the state does. Product-liability and recall insurers price the file's quality into terms, and their assessors read for exactly the artefacts this station prescribes - challenge records, surveillance rehearsals, nonconformity speed. And large customers audit suppliers against their own conformity checklists, which are converging on the same shape. A manufacturer whose self-assessment system satisfies these private examiners as a by-product has effectively recovered the notified body's discipline without its fees - and holds, in the audit reports, third-party-flavoured evidence of the system's operation that no amount of internal assertion can fabricate.

The mindset the model demands

Self-assessment rewards a specific temperament: the manufacturer who behaves as if an examiner will arrive, while knowing none is scheduled. Everything in this station is that temperament made procedural - challenge functions, rehearsals, currency registers. The opposite temperament also exists and is recognisable in its files: assembled once, kindly reviewed, quietly expiring. The regulation's bet is that surveillance plus liability sorts the two over time. A business does not need to share the bet to profit from the temperament; it needs only to notice which files it would rather own in year three of an incident.
