The PPWR and the Universal PFAS Restriction: Two Regimes, One Direction

Beyond packaging, a universal PFAS restriction is moving through ECHA that would phase the whole family out across applications, with derogations. How it interacts with Article 5 - and why packaging businesses should plan on the wider map.

The short answer

Two PFAS regimes are in motion. The PPWR's Article 5 thresholds govern PFAS in food-contact packaging now - a sectoral, threshold-based rule, applicable from August 2026. Behind it, the universal PFAS restriction proposal under REACH - submitted to ECHA by five national authorities and under evaluation - would restrict the manufacture, placing and use of PFAS as a class across essentially all applications, with time-limited derogations where alternatives are not yet available. The packaging thresholds are thus the first floor of a building whose upper storeys are still being designed.

For packaging businesses the interaction is strategic rather than legal in the short term: Article 5 compliance is owed on its own terms, but substitution investments should be chosen against the wider map, because a substitute chemistry that the universal restriction will also catch is a bridge to a second substitution.

Where the universal restriction stands

The restriction dossier is in the ECHA committee phase - risk and socio-economic committees working sector by sector through an enormous evidence base, with opinion-making measured in years and a Commission proposal and member-state vote behind that. Packaging is one sector among many (textiles, cosmetics, fluoropolymers and industrial uses carry their own chapters), and food-contact materials have featured in the dossier's scope discussions in ways that may overlap or absorb sectoral rules over time. This guide deliberately states the process position rather than predicting outcomes: the dossier's direction (class-wide restriction with derogations) is stable, its dates are not, and the desk re-issues this page as committee milestones land. Businesses should diary the milestones rather than the rumours.

Derogation logic: how the wider regime thinks

The universal proposal's derogation architecture is instructive even before it binds: time-limited relief (periods of years beyond the transition) for uses where alternatives are not available and substitution is genuinely hard, with the hardest industrial cases argued sector by sector. Packaging's position in that architecture is relatively exposed - few packaging PFAS uses are without alternatives, as the Danish paper experience demonstrated commercially. A business planning to argue essentiality for a packaging PFAS use should expect to lose to the market evidence of its own competitors' converted ranges. The substitution guide in this station is written on that assumption: the winning posture is to be the evidence that alternatives exist.

The planning posture the two regimes jointly imply

Three postures follow. Comply narrowly and now with Article 5: thresholds, screens, declarations - the station's preceding guides. Substitute with the wider map open: when choosing the replacement chemistry for a PFAS function, screen the candidate against the concern classifications and the restriction dossier's scope, so the substitute is not next year's problem. And watch the derogation and timeline milestones as procurement intelligence: the wider restriction will move input markets (fluoropolymer equipment components, processing aids, membranes) that packaging operations quietly depend on, and early notice is the entire value of the watching brief.

The equipment thread: PFAS inside the factory, not the pack

One under-discussed thread of the wider restriction reaches packaging operations directly: PFAS inside production equipment - fluoropolymer seals, membranes, release surfaces, lubricants in food and packaging machinery. A universal restriction with industrial derogations will price and schedule these uses, and maintenance and capex planning that ignores the thread will meet it as unplanned downtime or emergency derogation paperwork. Plant engineers should inventory critical fluoropolymer components alongside the packaging inventory this station prescribes - a different register, the same discipline - so the factory's own substitution runway is as visible as the product's.

The milestone watchlist

Four milestones convert this guide's landscape into dates as they land: the risk committee's opinion on the proposal's core scope; the socio-economic committee's treatment of sector derogations; the Commission's formal proposal, where derogation lengths become numbers; and the first member-state positions that signal the vote's shape. Each milestone is a trigger to re-read your substitution portfolio against the derogation map - not because packaging's own thresholds move (they are already law), but because input prices, equipment components and substitute chemistries reprice at every milestone. The desk logs them in the acts calendar as they occur.

Primary sources on the record

Legal status: Article 5 of Regulation (EU) 2025/40 in force for packaging; universal PFAS restriction proposal under REACH (ECHA process, pending). Application position for this topic: PPWR thresholds from 12 August 2026; universal restriction on its own multi-year timetable.
